課程概述 |
法律社會學相應於法律義理學與法律哲學,是一門相當年輕的科學。雖然帶有法律社會學式研究旨趣的研究作品具有相當久遠的學術傳統,但法律社會學成為一門獨立的學科卻是近百年來,尤其是社會學興起之後的事。縱然如此,回顧法律之社會學的發展歷史,這門學科卻又從來就不是社會學家的專寵。甚至我們可以說,早期關心他的人,法律學者要比社會學者來得多。
本課程首先將闡明的是法律和社會變遷此一研究領域的意義和重要性;其次,我們將探討社會規範和法律規範兩者之間的互補和互動關係,並且以實例說明社會規範形成和運作的面貌。接著,本課程將分析法律制度如何扮演推動社會變遷的角色,並且進而分析法院與社會變遷的關係。最後,本課程將自民主憲政和政治轉型期正義的觀點,探討民主憲政和社會變遷的相關議題,以及分析政治轉型期所面臨的諸多難題及其可能解決途徑。
